Terms and Conditions for 3D Secure Code Service

Please read the following terms of service carefully before using PNB 3D Secure service.
  1. The terms and conditions set out herein are in addition to the Issuer's General Terms and Conditions applicable for Punjab National Bank debit cards and credit cards.

  2. The following words and phrases shall have the following meanings in these Terms and Conditions:

    "Card" means debit or credit card issued by the Issuer in association with Visa International/MasterCard®/ NPCI.

    "Cardholder" means any person holding a valid Card issued by the Issuer and who desires to make payments to the Merchant over the Internet using the Card.

    "ID" means the user identification provided to the Cardholder by the Issuer to enable the Cardholder to make payments through the Internet using his Debit or Credit Card.

    "Issuer" means the financial institution that issued your debit card/credit card i.e. Punjab National Bank; "we", "us" and "our" refer to Issuer and its suppliers of card processing and web-hosting services; and "you", "your" or "yours" refers to the Cardholder using PNB 3D Secure Service

    "Merchant" means any person who owns or manages or operates the merchant establishment through a physical establishment and/or a website.

    "Password" means the passwords or any other means of authentication as the Issuer may specify, from time to time using which the Cardholder may make payments through the Internet using the Debit/Credit Card in a secured manner.

    "Registration Data" means the information asked by the Issuer in order to confirm the identity of the Cardholder before proceeding for one time IVR Registration. No registration is required for e-com transactions.

    These terms and conditions form a contract between the Cardholder and the Issuer for use of PNB 3D Secure. By using the PNB 3D Secure Service, the Cardholder shall be deemed to have accepted these Terms and Conditions. The Cardholder shall apply to the Issuer online for use of PNB 3D Secure Service by providing the Registration Data. The Issuer shall be entitled at its sole discretion to accept or reject such applications of the Cardholder.

  3. The Cardholder has understood the risks of using Internet medium for payment purposes and has taken all such professional or other advice as he/she considers necessary or appropriate in the circumstances and not in reliance on the information contained herein.

  4. After the card holder initiates a transaction and enters the card credentials, the same will be validated by the issuer and One time password (OTP) will be sent to his registered mobile number, customer should not share the OTP with anyone.

  5. The Issuer shall validate the Card details provided by the Cardholder during the course of a transaction directly and the Merchant will not be privy to the same. The Issuer shall not be liable for any omission in execution of any requests received through PNB 3D Secure Service due to circumstances beyond the reasonable control of the Issuer.

  6. PNB 3D Secure Service shall be provided at the discretion of the Issuer, which reserves the right to add, revise, suspend and /or cancel in whole or in part any of the services provided by PNB 3D Secure Service, without any notice and it shall be binding on the Cardholder.

  7. The Issuer in order to maintain the security of its systems, banking network, protection of its staff, detection of fraud and other crimes, including money laundering reserves the right to monitor, block or intercept use of PNB 3D Secure by the Cardholder.

  8. The Cardholder is aware that in case of payment over the Internet using his/her Card; the Cardholder will not affix his/her signatures on the charge-slips at the time of making the payment. Accordingly, the Cardholder accepts that, in the event of any dispute regarding the authenticity or validity of such a payment, for any reason whatsoever, the Cardholder's account shall be liable to be debited with the amount payable if the transaction was properly authorized by the Issuer/Visa International/MasterCard®/ NPCI. The Issuer shall not be liable, in any manner whatsoever, for the same.

  9. The Cardholder shall be solely responsible for the payments made through the Internet even in the event of the Cardholder claiming non-possession of the Card. The Cardholder shall further be solely responsible for any payments made using the Card through the Internet for travel and entertainment purposes or for availing any other services and cannot claim the invalidity of the same.

  10. Any payment made on the Internet using the Cardholder's details and OTP shall be deemed to be an instruction duly received from the Cardholder. The OTP sent on customers registered mobile, allows the Cardholder to make payments through Internet and that the Cardholder is the sole and exclusive owner of the OTP and accepts sole responsibility for use, confidentiality and protection of the OTP, as well as for all payments made using such OTP. The use of the Card by the Cardholder for making payments on the website is at the Cardholder's own risk and is the Cardholder's sole responsibility. It's for the Cardholder to ensure that he/she providing details and OTP to a secured website. The Issuer assumes no responsibility regarding the security and privacy features of any merchant.

  11. The Cardholder access to any merchant shall be at his/her sole discretion. The Cardholder acknowledges and agrees that the Issuer plays/undertakes no role in merchant promotion, selection, review or endorsement in any manner whatsoever and shall not be responsible or liable, directly or indirectly, for (i) the privacy practices of such merchants (ii) the content of such merchants websites including (without limitation) any advertising, content, products, goods or other materials or services on or available from such websites or resources or (iii) the use that others make of these websites or resources, nor for any damage, loss or offence caused or alleged to be caused by, or in connection with, the use of or reliance on any such advertising, content, products, goods or other materials or services available on such external websites or resources.

  12. The Cardholder shall indemnify and hold the Issuer, including its officers, employees and agents, against all losses and expenses on full indemnity basis, which the Issuer may incur, sustain, suffer or is likely to suffer in connection with the execution of the Cardholder's instructions and against all actions, claims, demands, proceedings, losses, damages, costs, charges and expenses as a consequence or by reason of providing the PNB 3D Secure Service.

  13. The Issuer has taken all reasonable steps to ensure the accuracy of PNB 3D Secure Service. However, the Issuer excludes any warranties, undertakings or representations (either express or implied) to the full extent permitted under applicable law that the service whether whole or in any part, its accuracy, availability or completeness are appropriate or available for use either in the India or in other jurisdictions. If the Cardholder uses this PNB 3D Secure Service from other jurisdictions, the Cardholder shall be responsible for compliance with applicable Indian and local laws.

  14. The Issuer accepts no liability (including without limitation) in either contract, tort, negligence, statutory duty or otherwise (to the maximum extent permitted by applicable law) arising out of the use of or access to this PNB 3D Secure Service (which includes without limitation) any errors or omissions contained in this service or if the service is unavailable the issuer shall not be liable for any direct or indirect : (a) economic losses (including without limitation loss of revenues, data, profits, contracts, use, opportunity, business or anticipated savings); (b) loss of goodwill or reputation; (c) special, incidental, consequential loss or damage; suffered or incurred arising out of or in connection with the cardholder's use of this service and these terms and conditions.

  15. The Issuer has no obligation to verify the authenticity of any payment made from the Card other than by means of verification of the Cardholder' s OTP

  16. All disputes, if any, arising out of or in connection with, or as a result of these Terms and Conditions or otherwise relating hereto, shall be subject to the exclusive jurisdiction of the competent courts/tribunals in Delhi only.

  17. In the event any provision of these terms and conditions is held unenforceable, it will not affect the validity and enforceability of the remaining provisions and will be replaced by an enforceable provision that comes the closest to the intention underlying the unenforceable provision.
